Title
A RESOLUTION relating to the operation and finances of the King County Flood Control Zone District, adopting the 2023 budget and authorizing improvements.
Body
WHEREAS, pursuant to RCW 86.15.140, the King County Flood Control Zone District ("the District") held a public hearing on the proposed 2023 budget of the District on November 8, 2022, and
WHEREAS, the board of supervisors ("the Board") desires to adopt the King County Flood Control Zone District's 2023 budget, and
WHEREAS, by Ordinance 15728, the King County council adopted the District's initial comprehensive plan of development for flood and stormwater control, which is titled "2006 King County Flood Hazard Management Plan," and by Resolution FCD2011-05.1, the District Board amended the initial plan to include a project in the city of Seattle (collectively, "the District Comprehensive Plan"), and
WHEREAS, pursuant to RCW 86.15.110, the Board must approve by resolution all flood control and storm water control improvements, prior to the extension, enlargement, acquisition or construction of such improvements, and
WHEREAS, RCW 85.15.110, further provides that such approval resolution must state whether the improvements are to be extended, enlarged, acquired or constructed; state that the comprehensive plan has been adopted; state that the improvements generally contribute to the objectives of the comprehensive plan; state that the improvements will benefit the county as a whole; state the estimated costs of the improvements; and identify the data supporting the estimated costs, and
WHEREAS, the Board desires to approve improvements in the District's 2023 budget that are not in the District Comprehensive Plan, or that have been modified by the District's 2023 budget, in accordance with RCW 85.15.110;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE KING COUNTY FLOOD CONTROL ZONE DISTRICT:
SECTION 1. The Board hereby adopts the 2023 Budget for the District, as set forth in Attachments A ("Work Program"), B ("2023 Annual Budget"), C ("2023 Annual Operating Budget"), D ("2023 Annual Capital Budget"), E ("2023 - 2028 Six-Year CIP"), F ("2023 Annual District Oversight Budget"), G ("2023 Subregional Opportunity Fund Allocations"), and H ("2023-2028 Six-Year CIP Project Allocations") to this resolution; provided that King County, or other jurisdictions contracted to implement projects, shall submit predesign reports for capital projects to the District executive director, and shall seek approval from the executive director of project charters. Furthermore, King County and other service providers as appropriate shall provide to the District executive director thirty percent design project reports for authorization to proceed with sixty percent design, sixty percent design project reports for authorization to proceed to ninety percent design, and ninety percent design project reports for authorization to proceed to one hundred percent design.
SECTION 2. The Board approves the extension, enlargement, acquisition, or construction, as applicable, of the improvements that are included in the District Comprehensive Plan, that are included in the District Comprehensive Plan but have been modified by Attachments C, D, and H to this resolution, or that are not included in the District Comprehensive Plan but are identified in Attachments C, D, and H to this resolution (collectively, "the improvements"). The District Comprehensive Plan includes the streams or water courses upon which the improvements will be enlarged, extended, acquired, or constructed. The Board determines that the improvements generally contribute to the objectives of the District Comprehensive Plan and will be of benefit to the county as a whole.
SECTION 3. The estimated costs of the improvements are stated in Attachments C, D, and H to this resolution and the supporting data for the estimated costs are on file with the director of the King County water and land resources division.
SECTION 4. For the improvements that will be constructed, preliminary engineering studies and plans either have been prepared or will be prepared, and have been filed or will be filed, with the director of the King County water and land resources division.
SECTION 5. The Board directs District executive director, District legal counsel, and King County to work collaboratively to develop template grant contracts for the contracts King County enters into as part of the administration of District grant programs. The template grant contracts shall be submitted to the District for approval by March 31, 2023.
SECTION 6. The Board reiterates its commitment to the principles of integrated floodplain management as stated in FCD20-07 and the District will continue reevaluating and reprioritizing Board approved Capital Investment Strategies as necessary to prioritize multibenefit projects to encourage an integrated floodplain management approach and focus on equity and social justice and environmental justice. This reevaluation and reprioritization will continue with the Capital Investment Strategies in the Snoqualmie Basin (Middle and South Fork Snoqualmie River and Tolt River Capital Investment Strategies). Additionally, this reprioritization will seek to find alignment with other plans such as the Snoqualmie Resilient River Corridor Management Plan and the 2017 recommendations of the King County Snoqualmie Fish, Farm, and Flood Advisory Committee. King County water and land resources division shall provide a proposed timeline for this reevaluation and reprioritization effort by May 31, 2023.
SECTION 7. The Board directs District executive director to work with King County water and land resources division to provide a quarterly report on the progress of the Sammamish River Capital Investment Strategy to interested stakeholders.
SECTION 8. The Board directs King County water and land resources division to provide a report on the King County Home Elevation Program. The report will include (1) existing need based on the number of property owners that have contacted the county to execute a Phase 1 contract to elevate their home including the number of property owners that are placed on a waitlist because of program capacity issues; (2) innovative ways or changes to the program that will decrease the time a property is on the waitlist; (3) propose an acceptable time a property stays on the waitlist; (4) identify resources necessary to address the identified need in order of priority. This report shall be transmitted to the District by March 31, 2023.
SECTION 9. The Board directs the District executive director and King County water and land resources division to provide regular updates to and seek the advice of the members of the District Advisory Committee related to the update of the 2006 King County Flood Hazard Management Plan.
SECTION 10. The Board directs the District executive director to provide members of the District Advisory Committee regular reports on capital and financial projections, including additional information on the "right-sizing" process for expenditure projections for all District service providers.
SECTION 11. The Board creates a Two Million Dollar "Countywide Strategic Acquisitions" capital project. Properties acquired with funds from this capital project shall be properties whose purchase will achieve a flood risk reduction benefit and align with the integrated floodplain management principles and multibenefits identified in District Motion FCD20-07. Additionally, properties acquired under this capital project shall not be associated with an adopted Capital Investment Strategy or another existing capital projects. The Board directs the District executive director and King County water and land resources division to follow the established acquisition approval process when acquiring properties as a part of this newly established capital project.
SECTION 12. The Board directs King County water and land resources division to provide a monthly report to the District executive director of the status of acquisitions of property necessary to implement capital projects identified in Attachment H to this resolution.
SECTION 13. The Board directs the Executive Director to provide a monthly report to the District Executive Committee on the status of acquisitions of property necessary to implement capital projects identified in Attachment H to this resolution.
SECTION 14. The Board directs King County water and land resources division to develop a workplan to begin implementing the recommended actions in the April 2022 Upper May Valley Drainage Study in 2023. The workplan shall be transmitted to the District by February 28, 2023.
SECTION 15. The Board reiterates its commitment to fund the portion of the boat used by the King County sheriff's office for District purposes and directs the King County sheriff's office to make the boat available for District purposes.
SECTION 16. The Board directs King County water and land resources division to provide a report to the District on the best practices for asset management for all facilities monitored and maintained by King County as service provider to the District.
SECTION 17. The Board directs King County water and land resources division to provide a monthly report to the District executive director on the status of inspections of all facilities monitored and maintained by King County as a service provider to the District.
SECTION 18. The Board reiterates its commitment to educating residents of King County about the dangers of dam failure and directs the District executive director to continue to work with the King County office of emergency management on a dam education and outreach program. The Board directs King County office of emergency management to convert one temporary term limited position to a full time equivalent position to support the District project delivery goals.
SECTION 19. The Board directs King County water and land resources division to convert three temporary term limited positions to full time equivalent positions to support District project delivery goals.
SECTION 20. The Board directs King County water and land resources division to provide a monthly report to the executive director on the status of recruitment and hiring of all vacant positions funded by the District.
SECTION 21. The Board directs the District executive director and King County water and land resources division to work collaboratively to evaluate options to ensure King County has the organizational capacity and structure to provide efficient and effective implementation of the District's work program.
SECTION 22. The Board directs King County water and land resources division to provide a quarterly report to the District executive director on the status of progress on items in the Work Program as set forth in Attachment A to this resolution.
SECTION 23. Section 3.6 of the interlocal agreement between the District and King County provides that King County shall notify the District executive director in writing if the county needs to modify or reprioritize capital projects. King County's notifications to the District executive director should include information regarding variations within project budgets of more than twenty percent in the "acquisition,"
"design," "construction," "contingency" and "total" expenditure categories, shown on Attachment D to this resolution.
