AN ORDINANCE authorizing the King County executive to condemn certain property for the replacement of the Lake Alice Road SE culvert, Right-of-Way No. 9-2012-003 Parcel 2, CIP No. 1026731, located in council district three.

STATEMENT OF FACTS:
1. The King County council, on November 14, 2012, by Ordinance 17476, did adopt the annual budget and program for 2013 and did provide therein for a transportation program and appropriated funds for the acquisition of property rights for the Lake Alice Road SE culvert replacement project.
2. The capital budget and program provides for the acquisition of property rights for the replacement of the Lake Alice Road SE culvert, Right of Way Plan Number 9-2012-003, CIP Number 1026731. Efforts to acquire the necessary property rights from the owner were unsuccessful.
3. In order to acquire the property rights required to facilitate construction of a new Lake Alice Road SE culvert and replace the roadway as shown on Right-of-Way Plan Number 313-64, it is necessary for King County to condemn certain property rights as hereinafter more particularly set forth.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The King County council deems the replacement of the Lake Alice Road SE culvert to be a public safety and use issue. Further, the King County council deems it necessary and in the best interests of the of the citizens of King County that a drainage easement for the property described in Attachment A to this ordinance be condemned, appropriated, taken, and/or damaged, subject to the making or paying of just compensation to the owner thereof in the manner provided by law.
SECTION 2. Condemnation proceedings are hereby authorized to acquire property and property rights together with the right to construct and maintain a drainage easement, as described in Attachment A to this ordinance, for the purpose of the subject culvert replacement and road repair.
