AN ORDINANCE authorizing the King County executive to enter into an intergovernmental land transfer agreement between King County and the Washington state Department of Natural Resources for the 28.22-acre Little Si Natural Area located at the southwest corner of the Mount Si Natural Resource Conservation Area.

STATEMENT OF FACTS:
1.  Under its conservation futures program, King County purchased the 28.22-acre Little Si Natural Area, located east of the city of North Bend in unincorporated King County.  The Little Si Natural Area is located adjacent to the approved boundary of and, therefore, eligible for inclusion in the Mount Si Natural Resource Conservation Area, managed by the Washington state Department of Natural Resources ("WADNR").
2.  The Little Si Natural Area was purchased in order to protect the forest adjacent to the Mount Si Natural Resource Conservation Area.  At the time of purchase, King County Ordinance 7736 documented the express intent to transfer the Little Si Natural Area to WADNR to manage along with the Mount Si Natural Resource Conservation Area.
3.  The King County department of natural resources and parks has determined that it will be more efficient for WADNR to manage Little Si Natural Area, because it already owns, manages and protects the much larger Mount Si Natural Resource Conservation Area that is adjacent to the Little Si Natural Area.  When transferred, the Little Si Natural Area will become part of the Mount Si Natural Resource Conservation Area.
4.  Pursuant to chapter 39.33 RCW and K.C.C. 4.56.140, King County may sell, transfer, exchange, lease or otherwise dispose of any real property to the state of Washington on such terms and conditions as may be mutually agreed upon by the proper authorities of King County and the state.
5.  Pursuant to K.C.C. chapter 4.56, before the public sale or trade of county-owned property, the King County facilities management division must first determine whether any other county department has a need for the property for government services.
6.  The King County facilities management division has formally declared Little Si Natural Area as surplus to the county's needs.
7.  King County and WADNR have agreed to the terms of an intergovernmental land transfer agreement for the transfer of fee title of the 28.22-acre site to WADNR.  
8.  Transfer of the fee title to the 28.22-acre site under the terms and conditions of the attached intergovernmental land transfer agreement will serve an important purpose for the county by ensuring that the site will remain dedicated to open space purposes and will remain open and available for public use.
9.  King County and WADNR have agreed that the transfer will take place within 30 days or as soon thereafter as possible, following execution of the intergovernmental land transfer agreement by both parties.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The King County executive is hereby authorized to enter into an intergovernmental land transfer agreement between King County and the Washington state Department of Natural Resources, substantially in the form of Attachment A to this
ordinance and such other documents as are necessary or convenient to complete the transfer.
