A MOTION authorizing the chair to sign a Memorandum of Agreement pertaining to the National Historic Preservation Act and the Lower Russell Road Levee Project.

WHEREAS, the Lower Russell Road Levee is a key part of the Green River levee system, and
WHEREAS, the King County Flood Control District ("the District") desires to improve the Levee ("the Project") to provide improved flood protection and habitat restoration, and
WHEREAS, the District started construction of Project in 2019, and
WHEREAS, during construction, 49 buried features of cultural significance were unearthed at the project site and the United States Army Corps of Engineers ("the Corps") consulted with the Muckleshoot Indian Tribe, the Snoqualmie Indian Tribe, the Stillaguamish Tribe of Indians, the Suquamish Tribe, the Tulalip Tribes, the District, the City of Kent, the Kent Historical Society, the Washington State Recreation and Conservation Office, the Washington State Historic Preservation Officer, and the King County Historic Preservation Program, and
WHEREAS, the Corps, the District, the City of Kent, the Washington State Historic Preservation Officer, as Signatory Parties, and the Muckleshoot Indian Tribe, the Stillaguamish Tribe of Indians, the Suquamish Tribe, the Washington State Recreation and Conservation Office and the King County Historic Preservation Officer, as Concurring Parties, have agreed that construction on the Project continue with stipulations to ensure the resolution of adverse effects to the historic properties associated with the Project;
NOW, THEREFORE, BE IT MOVED BY THE BOARD OF SUPERVISORS OF THE KING COUNTY FLOOD CONTROL DISTRICT:
SECTION 1. The chair of the King County Flood Control District is authorized to enter into the "Memorandum of Agreement pertaining to the National Historic
Preservation Act and the Lower Russell Road Levee Project," Attachment A to this motion.
