AN ORDINANCE authorizing the vacation of a portion of SE 403rd Street File V 2444.
Petitioners: Eugene and Karen Vezzetti and Walter and Sheri Anderson.

 

 

On 3/29/2004, a public hearing was held and closed.

 

 

Stafford Smith, Hearing Examiner, summarized the appeal issues, legal standards and new evidence
submitted.
Carolyn Lake, representing the appellant, Susan Martin, spoke and answered questions of the
Council.
Thomas Dickson, representing petitioners Walter and Sheri Anderson, spoke and answered
questions of the Council.
Dennis Gorley, Supervising Engineer, Road Services, Department of Transportation, spoke and
answered questions of the Council.
Neil Huff, respondent, spoke and answered questions of the Council.

The Chair opened the public hearing.
The following persons appeared to speak:

Eugene Vezzetti, applicant, spoke
Karen Vezzetti, applicant, spoke.
The public hearing was closed.

Mr. McKenna moved to remand Proposed Ordinance 2003-0180 to the Hearing Examiner to develop
an easement condition, so that cut-through traffic by third parties is not possible and that Ms.
Martin's tenant will have access from the eastside.

Mr. Hammond moved to recess for five minutes.

The chair recessed the meeting at 11:48 a.m.
The Chair reconvened the meeting at 12:00 p.m.

Mr. McKenna moved the following motion to remand, indicating it was reviewed and accepted by the
Prosecuting Attorney. "In order to avoid a special injury to Martin, I move to remand to the Hearing
Examiner to prepare a decision granting the requested vacation subject to a condition that the
Vezzettis and Andersons grant a limited easement for the benefit of the Martin parcel. This easement
shall require the installation of a gate or gates and include any other provisions necessary to limit
the easement's use to access the Martin parcel through the New Horizons subdivision". The motion
carried by the following vote:

Mr. Ferguson, Ms. Lambert, Mr. McKenna, Mr. Hammond, Mr. Gossett,
Ms. Hague and Mr. Irons
