STATEMENT OF FACTS:
1. King County, the Puget Sound Regional Council and the Washington state Department of Transportation entered into an agreement on or about September 23, 2009, titled The Lake Washington Urban Partnership Agreement ("the UPA"), which was awarded $139 million from the Federal Transit Administration ("the FTA"). The UPA is tied to the replacement of the SR 520 Lake Washington floating bridge and intends to improve traffic flow by pursuing congestion reduction strategies across Lake Washington including the "4Ts": tolling (congestion pricing); transit; telecommuting/transportation demand management; and technology.
2. The UPA provides funds for the acquisition of additional buses to increase transit service across Lake Washington, as well as for the infrastructure needed to collect tolls electronically, for improvements to passenger facilities including park-and-ride facilities, and for the installation of real-time information signs in the SR 520 corridor.
3. In order to provide enhanced transit services in the SR 520/Trans-Lake Washington corridor, the UPA designated $41 million for the acquisition of new buses by both Metro and Sound Transit to improve peak transit service.
4. The proposed agreement would commit Sound Transit to providing forty-eight additional one-way peak period trips in the SR 520/Trans Lake Washington corridor, a service level commitment that will require eleven new buses.
