      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.
      A.  Pursuant to RCW 70.48.390, Section 2 of this ordinance authorizes the Department of Adult and Juvenile Detention to assess inmates booked into a King County Jail Facility a fee to cover actual booking costs up to the maximum established by law.
      B.  RCW 70.48.390 authorizes local jurisdictions to assess an inmate booking fee based on the jail's actual booking costs or one hundred dollars, whichever is less.  This ordinance proposes a seventy-five dollar fee to be collected from adult inmates who are booked into county facilities in calendar year 2005
      SECTION 2.  There is hereby added to Title 5, Adult Detention, a new chapter to read as follows:
      Inmate booking fee.        The following fees apply as provided in this chapter:
      A.  Cost of booking:
        1.  Per booking:                                     $75.00
        B. Fee assessment criteria:
      1.   Based upon booking agency, jail facility type, and type of charge.  
      C.  Refund of booking fee:
        1.  If the inmate is not charged, is acquitted, or if all charges which are the basis for assessing the inmate booking fee are dismissed, the fee paid will be returned.
      SECTION 3.  Severability.  If any provision of this ordinance or its application to
 
any person or circumstance is held invalid, the remainder of the ordinance or the application of the provision to other persons or circumstances is not affected.
