AN ORDINANCE authorizing the King County executive to sign an interagency agreement between King County, a political subdivision of the state of Washington, and the city of Kirkland, a municipal corporation in the state of Washington, regarding the design, construction, operation and maintenance of a new crossing over the Eastrail Corridor.

STATEMENT OF FACTS:
1. King County and the city of Kirkland are owner jurisdictions of portions of the Eastrail Corridor.
2. Subject to easements by other entities, which are Puget Sound Energy, Sound Transit and the King County department of natural resources and parks, wastewater treatment division, the city owns portions of the corridor within the city limits, and the county owns portions of the corridor that are located both outside and within the city limits.
3. Lee Johnson Chevrolet dealership has purchased parcels of property for the new location of its dealership adjacent to the portion of the Eastrail Corridor owned by the county.
4. The new dealership location requires access across the county owned portion of the corridor at 134th Court NE for business to be conducted.
5. The city wishes to enter a thirty-year renewable use agreement with the county for the design, construction, operation and maintenance of the crossing.
6. The city will reimburse the county up to $600,000 for costs associated with rail removal and construction of an interim, gravel trail where the Eastrail Corridor connects with the city's Willows Road Connector project.
7. The city understands, acknowledges, and agrees that the corridor is part of an interstate freight corridor that has been "railbanked" subject to interim trail use under the National Trails System Act, also known as the Rails-to-Trails Act, 16 U.S.C. ?1247(d) and 49 C.F.R. ?1152.29.
