A RESOLUTION relating to risk management services and the purchase of insurance for the Flood Control Zone District; amending Resolution FCZD 2008-08.1, Section 3.

WHEREAS, RCW 4.96.041 authorizes the King County Flood Control Zone District ("District") to protect itself, and its supervisors, officers, employees, agents and volunteers against claims arising out of their performance, purported performance or failure to perform in good faith of their duties for the District; and
WHEREAS, in Resolution No. FCZD 2008-08.1, the Board of Supervisors of the District authorized the County to purchase and maintain insurance on the District's behalf, through April 1, 2009; and
WHEREAS, in Section 12.7 of the Interlocal Agreement Between the King County and the District Regarding Flood Protection Services, the District authorized and directed the County to procure and maintain insurance on the District's behalf at the District's expense, for the benefit of the District, its Board of Supervisors, officers, employees, agents and volunteers, and the Interlocal Agreement has a term of January 1, 2009 through December 31, 2010; and
WHEREAS, the Board of Supervisors have determined that it is in the District's best interests to authorize the County to purchase and maintain insurance on the District's behalf, until such time as the District directs the County otherwise; now, therefore
BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE KING COUNTY FLOOD CONTROL ZONE DISTRICT:
SECTION 1. Resolution FCZD 2008-08.1, Section 3, is amended to read as follows:
Procurement of Insurance. Beginning with the authorization of this resolution until ((April 1, 2009))April 10, 2010, and for each successive twelve month period thereafter until the District directs the County otherwise, the District authorizes the County to procure and maintain insurance on its behalf, and the District shall pay to the County the additional costs in insurance charges and costs in...
