Title
AN ORDINANCE authorizing the King County executive to enter into an amendment to the sewage disposal agreement with city of Carnation.
Body
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Findings:
      A.  King County ("county") and the city of Carnation ("city") are parties to an agreement for sewage disposal dated June 16, 2003.
      B.  By the terms of the agreement, the county is developing wastewater conveyance and treatment facilities to serve the city.
      C.  The agreement effectively establishes a surcharge on the uniform county sewer rate to help offset the capital cost of the facilities.
      D.  King County has adopted sewage treatment capacity charges at levels higher then projected in 2003 and the consequent increases in projected capacity charge revenues from city of Carnation customers enable reduction of the surcharge.
      E.  The parties now desire to amend the agreement to incorporate a lower surcharge level and an appropriate amendment has been prepared.
      SECTION 2.  The King County executive, or the executive's designee, is hereby authorized to enter into an amendment to the agreement for sewage disposal between King County and the city of Carnation, the amendment to be substantially in the form of Attachment A to this ordinance.
