STATEMENT OF FACTS:
1.  During its review and adoption of the critical areas ordinance, Ordinance 15051, the metropolitan King County council identified rural stewardship plans and farm management plans as two key incentive programs designed to reduce the impact of the ordinance on owners of rural and resource lands.
2.  Ordinance 15051 required that the details for the implementation of these two programs occur through the adoption of specific public rules to be developed by executive staff under K.C.C. chapter 2.98.
3.  Ordinance 15051 also provides for council oversight of public rules for rural stewardship and farm management plans through a report submitted by March 1, 2005, that summarizes and highlights the implementation requirements for these programs.
4.  K.C.C. chapter 2.98 places all authority to promulgate rules under the executive branch and do not allow for public rules to be changed by the council, even if there is a clear conflict between the adopted public rules and the adopted legislative intent of the council.
5.  Council oversight functions, in the case of a clear conflict between a public rule and council intent, can only be fully achieved by ordinance.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Ordinance 15051, Section 138, and K.C.C. 21A.24.--- are each hereby repealed.
      SECTION 2.  Ordinance 15051, Section 139, and K.C.C. 21A.24.--- are each hereby repealed.
 
      SECTION 3.  There is hereby added to K.C.C. Title 21A a new chapter entitled "Rural Stewardship Plans and Farm Management Plans."
