Title
AN ORDINANCE relating to land use decisions; allowing for council review of the decisions of the hearings examiner relating to reasonable use exceptions; and adding a new section to K.C.C. chapter 20.20.
Body
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      NEW SECTION.  SECTION 1.  There is hereby added to K.C.C. chapter 20.20 a new section to read as follows:
      Option for council review of examiner decisions regarding reasonable use exceptions.
      A.  A decision by the king county hearings examiner on the appeal of a reasonable use exception may be reviewed by the king county council when a written request for council review of the decision is submitted to the clerk of the council within fourteen days of the date of the examiner decision.
      B.  The council shall schedule a public hearing on the request for council review to a date no later than thirty days after the request is submitted.
      C.  The council review shall be based upon the record established during the public hearing conducted by the examiner.
      D.  The council action on the requested review shall be in the form of an ordinance either supporting, rejecting, or recommending reconsideration of, the examiner decision.
      E.  The council action may be appealed to superior court under the Land Use Petition Act.
      F.  There shall be no fee for the submittal of a request for review.
      SECTION 2.  Effective date and expiration date - submittal deadline.  Section 1 of this ordinance is effective January 1, 2005 through December 31, 2006.  All requests for council review authorized by this ordinance shall be submitted before December 31, 2006.
