Title
AN ORDINANCE establishing November 5, 2002, as the date for an election on the question of the formation of a park and recreation district encompassing portions of the Finn Hill annexation area, King County, Washington, and requesting in addition that the manager of records, elections and licensing place on the November 5, 2002, ballot the proposed district's ballot measures to authorize a six-year regular property tax for the district and elect the five initial parks commissioners.

STATEMENT OF FACTS:
1.  RCW 36.69.010 provides that "(p)ark and recreation districts are hereby authorized to be formed as municipal corporations for the purpose of providing leisure time activities and facilities and recreational facilities, of a nonprofit nature as a public service to residents of the geographical areas included within their boundaries."
2.  King County residents in an area near Finn Hill Park circulated a petition seeking to form a park district to area residents in accordance with chapter 36.69 RCW.
3.  In addition to petitioning for the creation of the park district, the petition also requested “the setting of a ballot measure for the approval of a six-year regular property tax levy to f[u]nd its operation.”
4.  On July 22, 2002, the records, elections and licensing division certified the sufficiency of the petition to the metropolitan King County council.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The name of the proposed park and recreation district shall be Finn Hill Park and Recreation District.
SECTION 2.  An election shall be held on the November 5, 2002, in accordance with chapter 36.69 RCW within the territory of the proposed park district, for the purpose of submitting the question of formation of a park district to the qualified electors within the proposed district described in section 4 of this ordinance.
      SECTION 3.  The King County manager of the records, elections and licensing services division is hereby requested to assume jurisdiction to call and conduct an election and submit to the registered voters within the subject area the proposition as set forth in section 3 of this ordinance.  The clerk of the council is hereby authorized and directed to transmit the proposition to the manager of the records, elections and licensing division in substantially the following form, with such additions, deletions or modifications in the ballot title as may be required for the proposition listed below by the King County prosecutor:

SECTION 4.  The boundaries of the proposed park and recreation district are described as follows:
      Begin at the intersection of the Lake Washington shoreline and the South boundary of the St. Edwards State Park, (E ½ Sec. 23. TWP.26. Range 4 E. Wm.) said point being the true Point Of Beginning (P.O.B.).
Proceed East on the S. bdy. St. Edwards State Park to 62 Ave. NE, South on 62 Ave. NE to the S. bdy. of the Kenmore Corporate limits.
East then following the Kenmore Corporate limits to 68 Ave. NE.
North on 68 Ave. NE to the S. bdy. St. Edwards State Park.
East on said boundary to Juanita Dr. NE.
North on Juanita Dr. NE to NE 143 St.
Northeasterly on NE 143 St. to NE 145 St.
North then following NE 145 St. to 92 Ave. NE.
North on 92 Ave. NE to Simonds Rd. NE.
Southeasterly then following Simonds Rd. NE to 100 Ave. NE.
South on 100 Ave. NE. to NE 132 St.
West on NE 132 St. to NE 131 Wy.
Southwesterly on NE 131 Wy. to the Western bdy. of the Kirkland Corporate limits.
South, then following said Corporate limits to its intersection with the shoreline of Lake Washington.
Southwesterly then following the shoreline of Lake Washington to the South bdy. of St. Edwards State Park, being the true P.O.B.
      SECTION 5.  The manager of the records, elections and licensing services division, is hereby authorized and requested to prepare and distribute a local voters' pamphlet, in accordance with K.C.C. 1.10.010, for the election called for in this ordinance, the cost of the pamphlet to be included as part of the cost of the election.
      SECTION 6.  The manager of the records, elections and licensing division is requested to include a ballot measure for the approval of a six-year regular property tax levy to fund the district's operation, as requested in the petition.
      SECTION 7.  The manager of the records, election and licensing division is requested to include a ballot measure that shall elect five park commissioners of
 
the district, as set forth in RCW 36.69.090, and to set, announce and hold a special filing period for those positions.
