Title
A MOTION related to the keeping of dogs and cats, clarifying the relationship between the provisions of K.C.C. Title 21A (Zoning Code) and K.C.C. Title 11 (Animal Control), and reinforcing the intent of the council in their adoption of K.C.C. 11.04.010.B to have the provisions of K.C.C. Title 21A prevail in any instance where there are conflicting provisions.
Body
      WHEREAS, a majority of the provisions of K.C.C. Title 11 (Animal Control) were adopted in the early 1970s and have remained largely unchanged in subsequent years, and
      WHEREAS, these provisions controlled all aspects of the keeping of animals, both within residences as household pets and within separate facilities regulated as commercial kennels/catteries or hobby kennels/catteries, and
      WHEREAS, in 1995, the council adopted and implemented K.C.C. Title 21A (Zoning Code), which included provisions regulating the keeping of animals within residences as household pets, and
      WHEREAS, K.C.C. Title 21A clearly provides greater flexibility than K.C.C. Title 11 in the number of household pets that may be kept within a residence, and
      WHEREAS, the council became aware of the conflicting provisions in 1998 and adopted Ordinance 13148 (codified in K.C.C. 11.04.010.B) to state its intent that the more recently adopted and more flexible provisions of K.C.C. Title 21A would prevail over any conflicting provision of K.C.C. Title 11, and
      WHEREAS, the council has become aware that this intent is not being implemented by King County animal control staff and that the number of household pets is being regulated solely on the basis of K.C.C. Title 11;
      NOW, THEREFORE, BE IT MOVED by the Council of King County:
      The county executive shall direct staff of King County animal control to implement all provisions of the King County Code as they pertain to the keeping
 
of household pets and to defer to K.C.C. Title 21A when there is any conflict with K.C.C. Title 11.
