AN ORDINANCE approving an amendment to the city of Redmond water franchise approved by Motion 9036 to construct, operate and maintain a water system in council district three and authorizing the executive to execute the franchise amendment.

      STATEMENT OF FACTS:
      1.  The city of Redmond has filed an application for an amendment to franchise 9036 in council district three to construct, operate and maintain a water system to serve single family residences in accordance with RCW 36.55.010 and K.C.C. chapter 6.27.
      2.  Franchise 9036 was approved by the King County council in 1993 by Motion 9036.  Franchise 9036 is consistent with the city of Redmond's 1992 Water Comprehensive Plan which was approved by the King County council by Ordinance 10765.
      3.  The amendment to franchise 9036 will allow the city of Redmond to provide water service to a portion of the Trilogy at Redmond Ridge Master Plan Development (MPD) that currently has no water service provider.
      4.  The city of Redmond through an interlocal arrangement with the Woodinville water district agreed to provide water service to that portion of the Trilogy MPD with no direct water service provider.  
      5.  The Woodinville water district under the Critical Water Supply Plan (CWSP) initially agreed to serve a portion of the Trilogy MPD.  During the review and processing of their water comprehensive plan through the utilities committee, the district substantially reduced the area that they agreed to serve under the CWSP.  As a result of this action, it created an area that had no water service provider for that portion of the MPD.
      6.  The utilities technical review committee (UTRC) concluded that the city of Redmond needed an amended comprehensive plan and franchise or a new franchise to provide water service to the development.  The UTRC determined that amending the current comprehensive plan and franchise would be the most expeditious way to resolve the water service issues.  
      7.  The Trilogy MPD received final plat approval from the King County Council on December 3, 2001.  Because the Trilogy MPD has received approval from the King County council and because the area to be added to the city of Redmond's franchise is a portion of the existing Trilogy MPD, the UTRC determined that providing service to this area is an addition and betterment to the water system.  The UTRC approved this addition and betterment as an amendment to the city's comprehensive water plan and recommended approval of an amendment to the city's existing water utility franchise 9036.
      8.  The amendment to franchise 9036 has been referred to the relevant county departments for review.
      9.  The King County executive has recommended approval of the franchise amendment.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The granting of an amended franchise to the city of Redmond to construct, operate and maintain a water system within King County is hereby approved.  The King County executive is authorized to enter into and execute the amended franchise attached hereto as Attachment A, which by this reference is fully incorporated herein.  Said amended franchise shall include all of the general and special conditions required by the county.
      SECTION 2.  If within thirty days after the granting of this amended franchise, the applicant shall have failed to sign the written acceptance incorporated herein, then the
 
rights and privileges granted herein shall be forfeited and said franchise shall be null and void.
