Title
AN ORDINANCE establishing May 21, 2002, as the date of a special election on the question of annexation and assumption of indebtedness to the city of Issaquah of an unincorporated area known as Providence Point/Hans Jensen; and declaring an emergency.
Body
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Findings:
      1.  The city of Issaquah, Washington, by Resolution 2002-19 has determined that it is in the public interest and general welfare to provide for the annexation of an area known as Providence Point/Hans Jensen, in accordance with chapter 35A.14 RCW.
      2.  City of Issaquah Resolution 2002-19 satisfies the provisions of chapter 35A.14 RCW for qualification for annexation.
      3.  The city of Issaquah, by Resolution 2002-19, initiated the annexation of the Providence Point/Hans Jensen annexation area.
      4.  The King County boundary review board received a request for review under chapter 36.93 RCW, and on February 15, 2002, the review board, in file 2114, deemed the proposed city of Issaquah - Providence Point/Hans Jensen annexation file approved.
      5.  Pursuant to chapters 29.13 and 35A.14 RCW, the metropolitan King County council deems an emergency exists for the purpose of calling a special election to be held on the question of this annexation on May 21, 2002.
      SECTION 2.  A special election shall be held on the 21st day of May 2002 in accordance with chapter 35A.14 RCW within the territory of the proposed annexation, for the purpose of submitting the question of annexation of the Providence Point/Hans Jensen annexation area and whether or not all property in the annexation area will assume its proportionate share of existing city bonded indebtedness.
      SECTION 3.  The number of registered voters within the subject area is estimated at one thousand four hundred forty as nearly as may be determined from available records.
      SECTION 4.  It is hereby found that anurgent need exists for the consideration by the electors of the proposed annexation.  Pursuant to RCW 29.13.010 and 35A.14.050, it is hereby deemed that an emergency exists.  The King County manager of the records, elections and licensing services division is hereby requested to assume jurisdiction to call and conduct a special election and submit to the registered voters within the subject area the proposition as set forth in section 4 of this ordinance.  The clerk of the council is hereby authorized and directed to transmit said proposition to the manager of records and elections in substantially the following form, with such additions, deletions or modifications in the ballot title as may be required for the proposition listed below by the King County prosecutor:
      PROPOSITION 1:  Shall the area of unincorporated King County contiguous to the city of Issaquah and commonly known as Providence Point/Hans Jensen, which is legally described in King County Ordinance_____ and city of Issaquah Resolution 2002-19, be annexed to and become part of the city of Issaquah?

      PROPOSITION 2:  Shall all property within the area, upon annexation, be assessed and taxed at the same rate as the property located within the city of Issaquah is assessed and taxed to pay for all or any portion of the then outstanding indebtedness of the city, which indebtedness has been approved by the voters, contracted for, or incurred prior to, or existing at, the date of annexation?

      SECTION 5.  Pursuant to RCW 29.36.121 and Motion 7393, the manager, records, elections and licensing services division, is requested to conduct the special election called for in this ordinance by mail ballot.
      SECTION 6.  The manager, records, elections and licensing services division, is hereby authorized and requested to prepare and distribute a local voters' pamphlet, pursuant to K.C.C. 1.10.010, for the special election called for in this ordinance, the cost of the pamphlet to be included as part of the cost of the special election.
      SECTION 7.  The boundaries of the territory proposed for annexation are hereby described in city of Issaquah Resolution 2002-19 as contained in Attachment A to this ordinance.
      SECTION 8.  In order for this ordinance to be effective in the time required by law for this item to be on the May 21 ballot this ordinance must be enacted by an emergency.  The council, therefore, finds as a fact and declares that an emergency exists
 
and that this ordinance is necessary for the immediate preservation of public peace, health, or safety or for the support of county government and existing public institutions.
