Ridgway; and amending the 2002 Budget Ordinance, Ordinance 14265, Sections 16, 28, 37, 43 and 75, as amended.

      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  There is hereby approved and adopted a supplemental appropriation of $3,051,015 from current expense fund balance and a disappropriation of $1,076,021 from executive contingency to the sheriff, prosecuting attorney, and public defense agencies, and making a supplemental appropriation of $1,374,962 from fund balance to the automated fingerprint identification system to pay for costs associated with the Green river homicide investigation and the case against Gary Leon Ridgway.  A balance of $1,173,947 remains in reserve in the current expense fund in anticipation of future expenditure requests related to the investigation and the case.
      SECTION 2.  Ordinance 14265, Section 16, as amended, is hereby amended by adding thereto and inserting therein the following:
      SHERIFF - From the current expense fund there is hereby appropriated to:
      Sheriff      $2,153,017
      The maximum number of additional FTEs for the sheriff shall be:      11.00
      PROVIDED THAT:
      This appropriation includes $50,397 for overtime benefits for sheriff's office personnel related to work on the Green river homicide investigation.  It is the council's understanding that the sheriff's office may submit future supplemental expenditure requests if the need arises for overtime allowances related to the investigation that exceed the amount included in this appropriation.
      PROVIDED FURTHER THAT:
      The sheriff's proposed staffing model for the Green river homicide investigation includes three additional positions that the sheriff's office may decide to fill should the needs of the investigation change.  This appropriation does not include FTE or expenditure authority for these three positions.  It is the council's understanding that the sheriff's office may submit future supplemental requests should the need for these Green river homicide investigation positions arise at a later date.
      PROVIDED FURTHER THAT:
      Of the amount appropriated in this ordinance, $500,000 shall only be expended pending the award of federal grant funding from the United States Department of Justice that shall be used for evaluation of DNA and other forensic evidence associated with this investigation.
      PROVIDED FURTHER THAT:
      The sheriff shall submit quarterly budget management reports to the budget and fiscal management committee no later than thirty days after each quarter ends for the purposes of informing the council of any changes in the investigation that may impact the financial status and/or appropriation to the sheriff's office.  The first report shall be provided to the council no later than July 30, 2002.  The reports shall include a summary that compares budgeted amounts to actual costs, significant changes in scope likely to affect subsequent costs, and a narrative description of the status of the investigation.  The reports shall also include, but not be limited to, any changes to the staffing model for the investigation including an update on hiring for backfill.  The reports shall also cover, to the extent possible, a breakdown of costs supporting the prosecution and costs for the continuing investigation of other Green river-related homicides.
      SECTION 3.  Ordinance 14265, Section 28, as amended, is hereby amended by adding thereto and inserting the following therein:
      PROSECUTING ATTORNEY - From the current expense fund there is hereby appropriated to:
      Prosecuting attorney      $1,215,563
The maximum number of additional FTEs for the prosecuting attorney shall be:      3.00
      PROVIDED THAT:
      Of the amount appropriated, funds must be spent on two deputy prosecuting attorney FTEs and one paralegal FTE dedicated to the State v. Ridgway case.  No funds may be expended for these FTEs after sixty days from the conclusion of the State v. Ridgway case.  Should the defendant be convicted and file notice of appeal, however, the prosecuting attorney may request that the executive forward a supplemental appropriation to the council to restore funding to continue at least one deputy prosecuting attorney to handle the resulting appeal or appeals.
      SECTION 4.  Ordinance 14265, Section 37, as amended, is hereby amended by adding thereto and inserting the following therein:
      EXECUTIVE CONTINGENCY - From the current expense fund there is hereby disappropriated from:
      Executive contingency      ($1,076,021)
      SECTION 5.  Ordinance 14265, Section 43, as amended, is hereby amended by adding thereto and inserting the following therein:
      PUBLIC DEFENSE - From the current expense fund there is hereby appropriated to:
      Public defense      $758,456
      SECTION 6.  Ordinance 14265, Section 75, as amended, is hereby amended by adding thereto and inserting the following therein:
