AN ORDINANCE authorizing the King County executive to enter into a ten-year use agreement between King County and the Mt. Peak Historical Fire Lookout Association for the design, construction, operation and maintenance of a lookout tower at Pinnacle Peak park, Enumclaw, Washington.

STATEMENT OF FACTS:
1. King County, a home rule charter county and political subdivision of the state of Washington, is the owner of the property located at 26838 SE 481st Street, Enumclaw, Washington, 98022, commonly known as Pinnacle Peak park.
2. The Mt. Peak Historical Fire Lookout Association is a nonprofit Washington corporation that is tax-exempt under section 501(c)(3) of the Internal Revenue Code and is a community-based, open-membership organization dedicated to the design and construction of a lookout tower similar to the historic fire lookout tower that once stood atop Mt. Peak.
3. King County has determined that a lookout tower at Pinnacle Peak park will have significant recreational value for the hiking public at Pinnacle Peak park.
4. King County Ordinance 14509 authorized the department of natural resources and parks to create new public recreation opportunities by empowering user groups, sports associations and community organizations, like the Mt. Peak Historical Fire Lookout Association, to operate, maintain and implement mutually agreed-upon capital improvements for public recreation facilities on King County land, and thereby address regional or rural recreation needs.
5. In accordance with K.C.C. 4.56.150.E., the King County council may adopt an ordinance permitting the county to enter into agreements for the use of county property with bona fide nonprofit organizations if the property is to be used by the nonprofit organization to make improvements to the county property or to provide services that will benefit the public. Those agreements are exempt from the requirements or fair market value, appraisal and notice.
