Title
AN ORDINANCE authorizing the King County executive to execute an amendment to the interlocal agreement with the King County flood control zone district extending the duration of the interlocal agreement up to December 31, 2020; and declaring an emergency.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. King County and the King County flood control zone district entered into the Interlocal Agreement Between King County and the King County Flood Control Zone District Regarding Flood Protection Services, effective January 1, 2016.
B. The county adopted Ordinance 18854 to extend the term of the interlocal agreement with the district from December 31, 2018, to December 31, 2019.
C. The county adopted Ordinance 19046 to authorizing the extension of the term of the interlocal agreement with the district for a period not to extend beyond from December 31, 2020.
D. The county and the district executed and amendment to the interlocal agreement extending its term to March 31, 2020, in order to give the parties time to negotiate a new interlocal agreement.
E. While the parties have made progress on a number of substantive terms to be included the new interlocal agreement, negotiations are ongoing.
F. The county and the district desire to continue to operate under the terms of the interlocal agreement until the terms of the new interlocal agreement are finalized and it is executed by the parties. To that end, and to preserve the status quo, at its March 4, 2020, meeting, the flood district executive committee recommended to the district's supervisors to extend the term of the current 2016 interlocal agreement up to December 31, 2020.
G. The third amendment to the interlocal agreement, Attachment A to this ordinance, amends the interlocal agreement to extend the term of mutually agreeable date certain but not to not exceed December 31, 2020.
