A MOTION authorizing the chair to enter into a Letter of Agreement between the King County Flood Control District and Muckleshoot Indian Tribe regarding the Lower Russell Road Levee Setback Project in Kent, WA.

Body

WHEREAS, the Lower Russell Road Levee is a key part of the Green River levee system; and

WHEREAS, the King County Flood Control District ("District") desires to improve the Levee ("the Project") to provide improved flood protection and habitat restoration; and

WHEREAS, the District started construction of Phase 1 of the Project in 2019; and

WHEREAS, the Muckleshoot Indian Tribe ("Tribe") has federal treaty rights protecting their historic fishing sites in the lower Green River; and

WHEREAS, the District and the Tribe ("the Parties") have consulted with the United States Army Corps of Engineers("Corps") regarding the permit required prior to construction of Phase 2 of the Project; and

WHEREAS, the Parties desire to proceed to Phase 2 of the Project in 2020;

                     NOW, THEREFORE, BE IT MOVED BY THE BOARD OF SUPERVISORS OF THE KING COUNTY FLOOD CONTROL DISTRICT:

                     SECTION 1. The chair of the King County Flood Control District is authorized to enter into the " Letter of Agreement between the King County Flood Control District and Muckleshoot Indian Tribe regarding the Lower Russell Road Levee Setback Project in Kent, WA," Attachment A to this motion.
