Title

AN ORDINANCE authorizing the King County executive to execute an amendment to the interlocal agreement with the King County flood control zone district extending the duration of the interlocal agreement; and declaring an emergency.

Body

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  Findings:

                     A.  King County and the King County Flood Control Zone District ("the district") entered into the interlocal agreement regarding flood protection services, effective January 1, 2016.

                     B.  The county enacted Ordinance 18854 to extend the term of the interlocal agreement with the district from December 31, 2018, to December 31, 2019.

                     C.  The county and the district desire to continue to operate under the terms of the interlocal agreement until a new one can be negotiated and adopted.  To that end, and to preserve the status quo, it is expected that the district's board of supervisors intend to meet on December 11, 2019 to authorize a second amendment to the interlocal agreement, substantially similar to Attachment A to this ordinance, to extend the term of the current 2016 interlocal agreement.    As acknowledged by the county executive in the executive's December 4, 2019, letter to the district's board chair, a target date for completion of the negotiations on a new interlocal agreement is not until late in the first quarter of 2020.

                     D.  The second amendment to the interlocal agreement, Attachment A to this ordinance, amends the interlocal agreement to extend its term to a mutually agreeable date certain but not to exceed December 31, 2020, in order to ensure the parties enough time to negotiate the new interlocal agreement and have it adopted by both parties.

                     E.  Extending the current interlocal agreement is necessary for the immediate preservation of the parties' ability to continue, without disruption, to provide flood management/protection services, which will preserve the health and safety of the residents of King County and help protect them from the ravages of flooding.

                     SECTION 2.  The council supports, and authorizes the executive to execute an amendment to the Interlocal Agreement Between King County and the King County Flood Control Zone District Regarding Flood Protection Services substantially in the form of Attachment A to this ordinance.  The council authorizes the executive to negotiate with the district for the term of the extension, which should not exceed the date of December 31, 2020.

                     SECTION 3.  The county council finds as a fact and declares that an emergency exists and that this ordinance is necessary for the immediate preservation of public peace,

 

health or safety or for the support of county government and its existing public institutions.
