Title

AN ORDINANCE revising the corporate boundary of the city of Enumclaw to include the unincorporated portion of Southeast 456th Street right-of-way as provided for in RCW 35A.21.210.

PREAMBLE:

It is in the county's best interest to allow cities within King County to manage the entirety of roads that coincide with the city's boundaries.  RCW 35A.21.210 provides the mechanism to allow cities with King County to adjust their boundaries to fully include roads on the cities' boundaries within the city.  RCW 35A.21.210 provides that "[t]he governing bodies of a county and any code city located therein may by agreement revise any part of the corporate boundary of the city which coincides with the centerline, edge, or any portion of a public street, road or highway right-of-way by substituting therefor a right-of-way line of the same public street, road or highway so as fully to include or fully to exclude that segment of the public street, road or highway from the corporate limits of the city."

Revision of the corporate boundary of a city becomes effective when approved by ordinance of the city council and the county council.

King County has jurisdiction over the road right-of-way for Southeast 456th Street from the intersection of 276th Avenue Southeast to the east line of Lot D, APN3020079089.

It is in the city and the county's best interest that the corporate boundary of the city is revised to include the portion of Southeast 456th road right-of-way currently within unincorporated King County.  This revision of the city’s corporate boundary will allow the city to make improvements to the entire road right-of-way under city standards and provide local services to its residents including the maintenance and operation of the public right-of-way.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  Findings:

                     A.  The corporate boundary of the city of Enumclaw currently extends along the north margin of the road right-of-way for Southeast 456th Street from the intersection of 276th Avenue Southeast to the east line of Lot D, APN3020079089.  A development within the city limits adjacent to the north margin of Southeast 456th Street is dedicating right-of-way to the city.  With the addition of the right-of-way dedicated to the city that is within the city limits, Southeast 456th road right-of-way will be partially in the city and partially in the county.

                     B.  The Enumclaw city council approved city of Enumclaw Ordinance 2613 to revise the city's corporate boundary at Southeast 456th Street to include approximately 0.30 miles of public right-of-way currently within unincorporated King County into the corporate limits of the city.

                     SECTION 2.  The revision of the corporate boundary of the city of Enumclaw to include the Southeast 456th Street public right-of-way currently within unincorporated King County, legally described as set forth in Attachment A to this ordinance, is hereby approved.
