Title
AN ORDINANCE approving an agreement to transfer land between King County and the city of Algona and authorizing the King County executive to sign and implement the agreement.

STATEMENT OF FACTS:
1. Concurrent with the introduction of this ordinance, the solid waste division of the department of natural resources and parks has requested approval by ordinance for the executive to sign and implement an agreement with the city of Algona relating to the construction of a new recycling and transfer station in the city.
2. If the agreement for the construction of a new recycling and transfer station in the city is approved under Ordinance xxxx (Proposed Ordinance 2017-xxxx), then the county and city desire to enter into a separate land transfer agreement for the transfer of the existing transfer station property to the city in accordance with chapter 39.33 RCW, chapter 39.34 RCW and chapter 35A.21.210 RCW.
3. The land transfer agreement provides that once the new transfer station opens, the existing transfer station will close, the structures on the existing transfer station property will be demolished, the property will be cleaned, as necessary, to meet industrial clean-up standards and the county will convey the existing transfer station property to the city. In exchange for the existing transfer station property, the city agrees to change its corporate boundary in accordance with chapter 35A.21.210 RCW to include within it a segment of West Valley Highway S in the city that is currently owned by the county. This will provide the city ownership of the entire right of way of West Valley Highway S between 5th Avenue South and 1st Avenue North and relieve the county of all maintenance and ownership responsibilities regarding the county-owned segment.
