A MOTION approving a report regarding options for providing electronic home detention and work education release programs, in compliance with the 2017-2018 Biennial Budget Ordinance, Ordinance 18409, Section 19, Proviso P1 and adopting policy regarding the electronic home detention and work education release programs.

                     WHEREAS, the 2017-2018 Biennial Budget Ordinance, Ordinance 18409, Section 19, Proviso P1, requires the executive to transmit a motion and report regarding options for providing work education release and electronic home detention by April 28, 2017, and

                     WHEREAS, the office of performance, strategy and budget worked with representatives from the department of adult and juvenile detention, superior court, district court, department of public defense, prosecuting attorney's office, council staff and other appropriate parties in the preparation of this report, and

                     WHEREAS, the group, working to develop the findings of the attached report, unanimously defined the preferred roles and desired outcomes for the work education release and electronic home detention programs, and

                     WHEREAS, the attached report provides options for work education release and electronic home detention based on the group’s identified preferred roles and desired outcomes, and

                     WHEREAS, the report analyzes the operating and capital costs of the proposed options and the potential effects of these options on the average daily population held in secure detention by the department of adult and juvenile detention, and

                     WHEREAS, the report includes a review of electronic home detention and work education release programs that have been implemented by other jurisdictions, and

                     WHEREAS, the report includes a review and description of legislative and statutory restrictions specific to electronic home detention and work education release programs, and

                     WHEREAS, in order to review the proviso response and to “consider and make recommendations on policies related to alternatives to incarceration such as electronic home detention, work education release or successor programs,” the council created the special committee on alternatives to incarceration through Motion 14819, and

                     WHEREAS, the special committee on alternatives to incarceration has held several hearings and heard testimony from the executive, superior court, district court, and representatives of other criminal justice agencies concerning how best to continue, improve, and make the work education release and electronic home detention programs more effective;

                     NOW, THEREFORE, BE IT MOVED by the Council of King County:

                      A.  It is the intent of council that King County’s work education release and electronic home detention programs will be part of a continuum of programs that provide alternatives to incarceration, help reduce recidivism and racial disproportionality in the criminal justice system, and improve public safety.  And that the intended goals of the continued operation of these programs will be to:

                       1.  Allow people to keep their jobs and continue their education, participate in job training or therapeutic courts, and participate in treatment programs;

                       2.  Use a needs assessment to determine which service will best address the underlying causes of criminal justice system involvement for each participant;

                       3.  Include only proven or promising evidence based programs;

                       4.  Expand the programs to include individuals who are readily employable; and

                       5.  Located to maximize access for residents across the county and to allow participants to utilize a variety of services to meet their needs.

                     B.  The report relating to options the provision of electronic home detention and work education release in King County in compliance with the 2017-2018 Biennial

Budget Ordinance, Ordinance 18409, Section 18, Proviso P1, which is Attachment A to this motion, is hereby approved.
