Title

AN ORDINANCE relating to the provision of regional animal services, authorizing the executive to enter into an interlocal agreement, Enhanced Control Services Contract and Enhanced Licensing Support Services Contract with cities and towns in King County for the provision of regional animal services.

STATEMENT OF FACTS:

1.  Ordinance 16862 authorized the county executive to enter into an interlocal agreement for provision of animal services to cities under a new regional model that enabled the county and cities and towns to provide for better public health, safety, animal welfare and customer service outcomes at a lower cost than jurisdictions are able to provide for on their own.  This was accomplished through properly aligned financial incentives, partnerships to increase revenue, economies of scale, a consistent regulatory approach across participating jurisdictions, and collaborative initiatives to reduce the homeless animal population and leverage private sector resources while providing for a level of animal care respected by the community.  Ordinance 17374 authorized the county executive to enter into a new three-year interlocal agreement for the provision of regional animal services, with an option to further extend the provision of such services through December 31, 2017.

2.  On April 4, 2016, the metropolitan King County council passed Motion 14605, accepting the Regional Animal Services Financial Sustainability Report, responding to the 2015/2016 Biennial Budget Ordinance, Ordinance 17941, Proviso P1, including negotiation principles and strategies to guide the county executive's interlocal agreement negotiation process for animal services.  The principals include:  lower costs to the county general fund; provide equity and social justice support to areas needing it; maintain or improve quality of animal outcomes currently being achieved by regional animal services of King County; maintain or improve service levels for public and contract partners; include additional cities ensuring outcomes and services are maintained and cost impacts can be mitigated; and utilize other facilities to enhance effectiveness, efficiency or capacity of animal care and sheltering in King County.

3.  All cities and towns identified in this ordinance have formally expressed their interest in participating in a regional animal services model that is in keeping with the interlocal agreement authorized by this ordinance.

4.  The interlocal agreement provides for a term of five years with an automatic extension, subject to a reopener option with notification, for an additional five-year term.  The interlocal agreement includes a cost allocation methodology that is based on program usage and population and shares dividing regional animal system costs between the county and all participating cities and towns.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The executive is hereby authorized to enter into an interlocal agreement in substantially the same form as Attachment A to this ordinance for the provision of regional animal services with the cities and towns of Beaux Arts, Bellevue, Black Diamond, Carnation, Clyde Hill, Covington, Duvall, Enumclaw, Issaquah, Kenmore, Kent, Lake Forest Park, Maple Valley, Mercer Island, Newcastle, North Bend, Redmond, Sammamish, SeaTac, Shoreline, Snoqualmie, Tukwila, Woodinville and Yarrow Point, and with such other cities that desire to enter into an interlocal agreement in substantially the same form as Attachment A to this ordinance.

                     SECTION 2.  The executive is authorized to enter into the Enhanced Control Services Contract and the Enhanced Licensing Support Services Contract with such cities and towns as may so request, in substantially the same forms as are included as Exhibit E and Exhibit F to Attachment A to this ordinance.

                     SECTION 3.  A. By November 30, 2020, the executive shall transmit a report on regional animal services of King County program outcomes and financial sustainability and a motion to acknowledge receipt of the report.  The report shall include without limitation:

                       1.  A summary of regional animal services of King County program outcomes regarding animal control field response, sheltering, and licensing services provided to unincorporated areas of King County, disaggregated by ZIP Code, annually for the years 2017, 2018, 2019 and through August 31, 2020;

                       2.  A summary of regional animal services of King County program outcomes regarding animal control field response, sheltering, and licensing services provided to contracting cities annually for the years 2017, 2018, 2019 and through August 31, 2020;

                       3.  Analysis of county general fund support for the regional animal services of King County program over time since 2013, including estimated financial support biennially through the 2023-2024 biennium;

                       4.  Analysis of the regional animal services of King County operating fund balance over time since 2017, including estimated ending fund balance biennially through the 2023-2024 biennium; and

                       5.  The executive's recommendation whether to extend the 2018 regional animal services interlocal agreement for a second five-year term as described in section 4 of the interlocal agreement.

                     B.  The executive shall file the report and a motion to acknowledge receipt of the report no later than November 30, 2020, in the form of a paper original and an electronic copy with the clerk of the council, who shall retain the original and provide an electronic copy to all councilmembers, the council chief of staff and the lead staff for the government accountability and oversight committee, or its successor.

                     C.  If the council does not pass a motion acknowledging receipt of the report by April 30, 2021, then, unless provided authority through an ordinance approved by council to renew the 2018 regional animal services interlocal agreement for a second five-year term, the executive or the executive's designee shall no later than June 30, 2021, give notice to the other Contracting Parties, in accordance with sections 4.a. and d. of the interlocal agreement, advising them of the county's intent to opt out of the automatic renewal for a second five-year term and determination to terminate its participation in the agreement at the end of the agreement's initial five-year term.
