AN ORDINANCE approving the 2016 Comprehensive Plan Update Water & Sewer Systems Cedar River Water and Sewer District.

STATEMENT OF FACTS:

1.  King County has adopted K.C.C. chapter 13.24, which requires approval of comprehensive plans for water and sewer utilities that provide service in unincorporated King County as a prerequisite for operating in unincorporated King County, receiving approval for annexation proposals, being granted right-of-way franchises, and being given approval for right-of-way construction permits.  K.C.C. chapter 13.24 prescribes the requirements for approval of such plans, including consistency with state and local planning requirements.

2.  The Cedar River Water and Sewer District's last general facility plan was approved in 2008.  Washington state Department of Health, Washington State Department of Ecology and King County regulations require water and or sewer system plans to be updated every six years.

3.  The district has a service area within King County and has adopted a water and sewer systems plan update ("the plan").

4.  King County has adopted a Comprehensive Plan that includes policies F-101 through F-264, the applicable portions of which address water and sewer policies for facilities and services; these water and sewer policies call for consistency with other adopted plans, pursuit of reclaimed water, water conservation and protection of water resources.

5.  K.C.C. chapter 13.24 requires the utilities technical review committee to review and make a recommendation to the King County executive and council on the plan, the requirements under K.C.C. chapter 13.24 and consistency with the King County Comprehensive Plan.  The utilities technical review committee has reviewed the planning data and system operations and has found:

  a.  The plan uses population and employment forecasts developed by the Puget Sound Regional Council;

  b.  The district's service areas includes portions of unincorporated King County.

  c.  The district provides sewer service to the Rainier Christian School in the rural area.  Service to the school was initiated before the establishment of the urban growth boundary.  The school owns parcel number 252305-9050 that has four structures, one of which is dry, and the other three discharge wastewater to a one-thousand to one-thousand-one-hundred gallon holding tank.  The tank's effluent flows to a two and one-half inch force main that discharges to the district's system number four.  The nonconforming sewer service to the rural area is allowed for the existing use; any future expansion or redevelopment must meet existing code;

  d.  The capital facility plans are adequate to meet anticipated facility and service needs;

  e.  The plan is consistent with applicable Washington state water quality laws; and

  f.  The plan is consistent with other pertinent county adopted plans and policies.

6.  Washington state Department of Health and state Department of Ecology approval is pending upon King County's approval of the plan.

7.  Under the state Environmental Policy Act the district completed an environmental check list and the district issued a determination of nonsignificance for the plan approval on June 6, 2016.  There were no appeals.

8.  The district's operations and facilities meet multiple existing statutory, administrative and planning standards.  As the district's operations, facilities and planning meet the requirements of the King County Code and are consistent with the King County Comprehensive Plan, the utilities technical review committee has recommended approval of the plan.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The 2016 Comprehensive Plan Update Water & Sewer Systems

Cedar River Water and Sewer District, Attachment A to this ordinance, is hereby approved as a comprehensive water and sewer system plan.
