AN ORDINANCE adopting a special assessment roll to fund the approved activities of Lake Management District No. 2 in the Lake Geneva watershed; and declaring an emergency.

STATEMENT OF FACTS:

1. Ordinance 18282 created the Lake Management District No. 2 in the Lake Geneva watershed.

2. Ordinance 18282 also required the hearing examiner to hold a public hearing on the proposed special assessment roll and make a recommendation on the assessment roll to the King County council.

3. The examiner held the public hearing on May 26, 2016, and issued a decision on May 27, 2016.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  Findings:  This ordinance must be enacted as an emergency ordinance in order to allow the district to immediately begin operations on its work program and obtain funding for its work program for 2016.

                     SECTION 2.  A.  This ordinance does hereby adopt and incorporate herein as its findings and conclusions the findings and conclusions contained in the report and recommendation of the hearing examiner dated May 26, 2016, Attachment A to this ordinance.

                     B.  The special assessment roll, Attachment B to this ordinance, is hereby adopted for 2016. The special assessment roll shall be adjusted annually through 2026, consistent with chapter 36.61 RCW. The special assessments shall fund the activities described in the lake management plan adopted in Ordinance 18228, within the boundaries established with Ordinance 18282.

                     SECTION 3.  As part of its administrative duties, the water and land resources division of the department of natural resources and parks shall request that the treasurer set up an account on behalf of the district to manage the revenue and expenditures of the district.

                     SECTION 4.  The county council finds as a fact and declares that an emergency exists and that this ordinance is necessary for the immediate preservation of public peace,

health or safety or for the support of county government and its existing public institutions.
