STATEMENT OF FACTS:
1.  The Baring Water Association filed an application for a water franchise to operate and maintain water pipelines and appurtenant facilities in unincorporated King County for the purpose of providing water service in King County.
2.  The Baring Water Association's Comprehensive Water System Plan was approved by the King County council in accordance with a recommendation of the King County utilities technical review committee.
3.  The utilities technical review committee has approved the Baring Water Association franchise application as meeting the requirements of K.C.C. 6.27.060 and 13.24.010.
4.  The council has scheduled, noticed and conducted a public hearing regarding the Baring Water Association application for a right-of-way franchise on the _________ day of _________, 2014, as required by RCW 36.55.040 and K.C.C. 6.27.050.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The metropolitan King County council, having determined that the Baring Water Association application meets the criteria for the granting of a water franchise and that the grant is in the best interests of the public, does hereby approve the attached franchise agreement and authorizes the King County executive to execute the agreement.
      If, within forty-five days after the granting of the franchise, the applicant fails to
sign the written acceptance incorporated in this ordinance, then the rights and privileges granted in this ordinance shall be forfeited and the franchise shall be null and void.
