AN ORDINANCE approving a long-term ground lease agreement with Galvin Aviation, LLC, at King County international airport in council district eight.

      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Findings:
      A.  King County international airport provides essential aviation services to the citizens of King County.
      B.  The King County executive is authorized to lease real property in accordance with the provisions of K.C.C. 4.56.150, 4.56.160, 4.56.180 and chapter 15.72 for a term of years not to exceed thirty-five years.
      C.  The King County executive has negotiated a lease agreement providing for a fixed base operator at King County international airport.
      SECTION 2.  The King County council, having determined that the proposed lease agreement is in the best interest of the public, hereby authorizes the executive to execute the lease agreement in substantially similar form as provided in the attachment to this ordinance and to take all actions necessary to implement the lease agreement.  All actions up to now taken by county officials, agents and employees consistent with the terms and purposes of the lease agreement are hereby ratified, confirmed and approved.
      SECTION 3.  If any one or more of the covenants or agreements provided in this ordinance to be performed on the part of the county is declared by any court of competent jurisdiction to be contrary to law, then such covenant or covenants, agreement or agreements are null and void and shall be deemed separable from the remaining
covenants and agreements of this ordinance and in no way affect the validity of the other provisions of this ordinance or of the lease.
