AN ORDINANCE revising the corporate boundary of the city of Bellevue to include an unincorporated portion of Lakemont Boulevard SE right-of-way as provided for in RCW 35A.21.210

STATEMENT OF FACTS:
1. The Coal Creek Natural Area annexation to the city of Bellevue was completed in 2009.
2. It was discovered that approximately two hundred feet of Lakemont Boulevard SE public right-of-way was excluded from the Coal Creek Natural Area annexation and remains unincorporated King County right-of-way.
3. The city of Bellevue agrees that this portion of Lakemont Boulevard SE public right-of-way excluded from the Coal Creek Natural Area annexation should be within Bellevue's jurisdiction.
4. It is in the city's and the county's best interest to have this right-of-way under the city's jurisdiction so that the city may provide local services to its residents related to the maintenance and operation of the public right-of-way.
5. The city approved ordinance number 6069 to revise its corporate boundary at Lakemont Boulevard SE to include the unincorporated portion of the public right-of-way within the corporate limits of the city.
6. RCW 35A.21.210 authorizes "the governing bodies of a county and any code city located therein may by agreement revise any part of the corporate boundary of the city which coincides with the centerline, edge, or any portion of a public street, road or highway right-of-way by substituting therefore a right-of-way line of the same public street, road or highway so as fully to include or fully to exclude that segment of the public street, road or highway from the corporate limits of the city."
7. Revision of the corporate boundary of a city is effective upon approval by the city council and the county legislative authority as provided for in RCW 35A.21.210.
