STATEMENT OF FACTS:
1. On April 30, 2007, the King County ("the county") council approved Ordinance 15739, establishing the King County ferry district ("the district"). As authorized by RCW 36.54.110, the district is a municipal corporation, an independent taxing authority within the meaning of Article VII, section 1 of the state Constitution, and a taxing district within the meaning of Article VII, Section 2 of the state Constitution.
2. On April 14, 2008, the county and the district entered into an interlocal agreement, as authorized by King County Ordinance 16055 and district Resolution FD 2007-05, whereby the county as service provider to the district would provide ferry services and implement the district's annual work program and budget.
3. When submitting the third amendment to the interlocal agreement in November 2011, it was noted that the interlocal agreement would need to be updated to better reflect the current status and expectations of the water taxi service and the relationship between the district and the county.
4. On _____________, 2012, the King County ferry district board approved Resolution FD2012-_____, authorizing the chair of the ferry district board to execute a new interlocal agreement with King County that provides negotiated changes to update and clarify responsibilities and update terms and conditions for a two-year extension of the agreement expiration date, to December 31, 2014.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
