STATEMENT OF FACTS:
1.  Ordinance 9368, originally approved by the King County council on March 27, 1990, established the housing opportunity acquisition fund as a first tier capital improvement ("CIP") fund, designated as fund no. 0322, the purpose of which is to acquire, renovate and construct housing for low-income families, seniors at risk of displacement and homelessness, homeless individuals and persons with special housing needs funded by real estate excise tax.
2.  The housing opportunity acquisition fund is used by the county primarily to fund low-income housing development and the provision of homeless assistance program services by community not-for-profit organizations, and King County does not acquire or hold title to any capital asset to the housing capital or services projects developed and supported under the fund.
3.  Staff from the finance and business operations division and the office of performance, strategy and budget are in agreement that the housing opportunity acquisition fund functions more like an operating fund than a CIP fund with purposes not limited to acquisition, and should appropriately be reclassified to that of an operating fund named the Housing Opportunity Fund.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Ordinance 9368, Sections 1 and 2, as amended, and K.C.C. 4.08.235 is hereby amended to read as follows:
      A.  There is hereby ((established a)) created the housing opportunity fund((, a capital improvement fund, designated as fund no. 322)).
      ((This)) B.  The fund shall be a first tier fund as described in ((K.C.C. 4.10.010)) this chapter.  It is a special revenue fund.
      C.  The ((planning and community development division manager)) director of the department of community and human services shall be the manager of the fund ((manager)).
      D.  The ((purpose of the)) fund ((is to)) shall support non-county organizations which  acquire, renovate ((and/or)), construct housing for very low to moderate-income individuals and families, ((seniors at risk of displacement and homelessness, homeless individuals and persons with special housing needs)) including homeless households and households with special housing needs by securing a property interest in each project.  The fund may also support housing operating costs, rental assistance and services for low-income individuals and families, including homeless households and households with special housing needs. ((Real estate excise tax will be used to support the fund)).
      SECTION 2.  Ordinance 12076, Section 9, as amended, and K.C.C. 4.08.015 is hereby amended to read as follows:

      B.  The following shall also be first tier funds:
        1.  All funds now or hereafter established by ordinance for capital construction through specific road improvement districts, utility local improvement districts or local improvement districts.  The director of the department of transportation shall be the fund manager for transportation-related funds.  The director of the department of natural resources and parks shall be the fund manager for utility-related funds.
        2.  All county funds that receive original proceeds of borrowings made under Chapter 216, Washington Laws of 1982, as now existing or hereafter amended, to the extent of the amounts then outstanding for the borrowings for that fund.  For purposes of this subsection, the director of the county department or office primarily responsible for expenditures from that fund shall be the fund manager.
        3.  Any other fund as the council may hereinafter prescribe by ordinance to be
invested for its own benefit.  County funds shall be treated as provided in K.C.C. 4.10.110 unless a designation is made by the council.
