AN ORDINANCE waiving certain statutory and code requirements relating to the independent audit of the elections section of the King County records, elections and licensing services division; and declaring an emergency.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. The council, the executive and the general public have identified issues of concern within the elections section of the King County records, elections and licensing services division related to the operations, processes and accuracy of the 2004 general election.
B. The metropolitan King County council wishes to secure a contract with an independent consultant to conduct a management and systems audit of the elections section of the King County records, elections and licensing services division as described in Motion _____.
C. The metropolitan King County council wishes to expedite the procurement process to secure a contract so that the results of such an audit may, in a timely manner, inform and assist the council with any policy decisions, and inform and assist the executive with any management decisions regarding the efficient and accurate operation of the elections section of the King County records, elections and licensing services division.
D. An emergency waiver of competitive bidding and formal solicitation requirements of state and county law is necessary to assure the timely availability of the results of the audit necessary to prevent delay in the performance of the elections section of the King County records, elections and licensing services division.
SECTION 2. The requirements for competitive bidding and formal solicitation of services under chapters 36.32, 39.80 and 39.10 RCW and K.C.C. chapters 4.04, 4.16, 4.18, 12.16 and 12.18 are hereby waived with reference to any contracts relating to the independent audit of the elections section. This waiver expires upon completion of this project.
