AN ORDINANCE approving a franchise for the Locloman Water Association to construct, operate and maintain a water system in council district 12, and authorizing the executive to execute the franchise agreement.

      STATEMENT OF FACTS:
1.  The Locloman Water Association has filed an application for a franchise in council district 12 to construct, operate and maintain a water system to serve single family, residential dwelling units in accordance with RCW 36.55.010 and K.C.C. chapter 6.27.
2.  The Washington State Department of Health has classified this public water system as non-expanding as defined in WAC 246-290-010.  
3.  K.C.C. 13.24010D exempt nonexpanding public water systems from preparing water comprehensive plans for county approval.
4.  The  application has been referred to the relevant county departments for review.
5.  The King County executive has recommended approval of the franchise.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The granting of a franchise to the Locloman Water Association to construct, operate and maintain a water system within King County is hereby approved.  The King County executive is authorized to enter into and execute the water system franchise, which by this reference is fully incorporated herein.  This franchise shall include all of the general and special conditions required by the county.
      SECTION 2.  If within thirty days after the granting of this franchise, the applicant
 
shall have failed to sign the written acceptance incorporated herein, then the rights and privileges granted herein shall be forfeited and this franchise shall be null and void.
