AN ORDINANCE authorizing the King County executive to execute an interlocal agreement with the city of Duvall relating to limitations on uses within a portion of the city of Duvall Urban Growth Area.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. On October 6, 2008, King County adopted Ordinance 16263, which amended the Urban Growth Area boundary to include additional properties.
B. Map Amendment 24 of Ordinance 16263 added property currently owned by Ray and Tove Burhen to the Urban Growth Area of the city of Duvall, as well as applied property-specific conditions.
C. Two conditions, applicable to the southerly 24.81 acres of the new Urban Growth Area, were:
1. "Future use shall be limited to farm heritage park or other public recreational use," and
2. "King County and the City of Duvall shall enter into an Interlocal Agreement prior to annexation, committing the city to the use of this acreage for the farm heritage park or other public recreational use."
D. The city of Duvall and King County have agreed to terms of an interlocal agreement that fulfill the property-specific conditions of Map Amendment 24.
E. The terms of the attached interlocal agreement will serve an important county purpose by ensuring that the affected property will remain a farm heritage park or other public recreational use after annexation of the property into the city of Duvall.
F. The Duvall city council is expected to approve the attached interlocal agreement in the fall of 2009.
SECTION 2. The county executive is hereby authorized to execute an interlocal
agreement with the city of Duvall, substantially in the form of Attachment A to this ordinance.
