STATEMENT OF FACTS
1. The King County council, on November 24, 2003, by Ordinance 14797, adopted the annual budget and program and provided therein for a transportation program in 2004 that included a project to expand and improve the Burien Transit Center located at 14900 4th Avenue SW, Burien, Washington 98166 under appropriation A00565 in the passenger facilities program of the public transportation fund capital budget.
2. The King County council, on November 21, 2005, by Ordinance 15333, adopted the annual budget and program and did provide therein for a transportation program in 2006 that included an increase in funding for a project to expand and improve the Burien Transit Center located.
3. The capital budget and program provides for the acquisition of land necessary for the improvement and expansion of the transit center. Acquisition of such land is required to construct improvements including providing an off-street transit loading facility with four bus bays and capacity for eight coaches and provisions for on-site layover of up to eight coaches. The facility will also include dedicated facilities for ACCESS Transportation. The expansion of this facility will serve the over four thousand rides who currently board coaches at the existing facility and will include passenger amenities, safety, security and information improvements. The project is consistent with area transit service plans and is supported by the city of Burien.
4. In order to acquire the property and property rights required to improve and expand the Burien Transit Center as designed, it is necessary for King County to condemn the land and property rights and rights in property for the parcel as more particularly set forth in Attachment A t...
