AN ORDINANCE relating to the annexation of approximately 11.4 acres of land into the Midway Sewer District for the purpose of providing sanitary sewer service.

      STATEMENT OF FACTS:
1.  A notice of intention proposing the annexation of approximately 11.4 acres of land into the Midway Sewer District for the purpose of providing sanitary sewer service was filed with the county council effective December 11, 2003.
2.  Midway Sewer District has found the petition for transfer to be sufficient and has concurred with the proposed transfer in Resolution No. 2003-19, passed on October 22, 2003.
3.  Midway Sewer District filed a Determination of Nonsignificance on the proposed annexation dated October 22, 2003.
4.  The utilities technical review committee recommended county council approval of the proposed annexation.  
5.  The county council held the legally required public and has considered the criteria in RCW 57.02.040.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The annexation of approximately 11.4 acres of into Midway Sewer District for the purpose of providing sanitary sewer service described in Attachment A of this ordinance is approved.  This proposed annexation is consistent with RCW 57.02.040.
      SECTION 2.  Midway Sewer District is the appropriate entity to serve the area proposed to be annexed.
      SECTION 3.  Completion of this annexation does not constitute county approval
 
or disapproval of any other permits, certifications or actions necessary to provide service to this annexation area.
