AN ORDINANCE authorizing the execution of a franchise agreement with Kuhn Acres LLC, for use of King County road rights of way within its franchise area for the construction and maintenance of water facilities.

STATEMENT OF FACTS:

1.  Kuhn Acres LLC applied for and negotiated terms and conditions for use of King County road rights of way for the construction and maintenance of water facilities within its franchise area in council district eight.

2.  The application and negotiated document was reviewed and approved by applicable county agencies before submission to the council.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The Kuhn Acres LLC application and negotiated agreement meets the criteria for a right-of-way franchise for use of the right of way of county roads for the construction and maintenance of water facilities under K.C.C. chapter 6.27.

                     SECTION 2.  The executive is authorized to execute a right-of-way franchise agreement with Kuhn Acres LLC that is substantially in the form of Attachment A to this

ordinance, and to take all actions necessary to implement the terms of the franchise agreement.
