Title

AN ORDINANCE denying the vacation of a portion of 43rd Ave S, V-2750; Petitioners:  Drake Randle and William and Vikki Johnson.

STATEMENT OF FACTS:

1.  A petition has been filed requesting vacation of a portion of 43rd Ave S in the Renton area of unincorporated King County, hereinafter described.

2.  The department of local services notified utility companies serving the area and King County departments of the proposed vacation.  Puget Sound Energy and King County road services division identified infrastructure located within the vacation area.

3.  The department of local services's records indicate that this segment of right of way is open, improved and maintained.

4.  The segment of right of way serves as one of three points of access to Camelot park, a King County park.

5.  The department of local services considers the subject portion of right of way useful as part of the county road system and believes the public would benefit by the retention of the portion of right of way and recommends denial of the vacation petition.

6.  Due notice was given in the manner provided by law.  The office of the hearing examiner held the public hearing on ________, ______, 2024.

7.  As detailed in the _________, ___ 2024 recommendation, the hearing examiner found that the road segment subject to this petition is useful as part of the King County road system, concluded that the vacation of this segment of road will not benefit the public, and recommended denial of the vacation petition.

8.  In consideration of the recommendations of the county road engineer and hearing examiner, the council determines that it is in the best interest of the citizens of King County to deny said petition.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The council, on the effective date of this ordinance, hereby denies

the petition to vacate a portion of 43rd Ave S right of way as filed under vacation file V-2750.
