STATEMENT OF FACTS:
1.  King County and the city of Mercer Island (city) have agreed to terms for an interlocal agreement for the transfer of Luther Burbank park.
2.  The recitals in the agreement set forth relevant facts supporting and explaining the terms of the transfer.
3.  The equipment and supplies being conveyed along with the park are integral to the continued operation and maintenance of the park and are surplus to the county's needs.
4.  King County and the city have agreed that the transfer will take place December 31, 2002.
5.  Transfer of Luther Burbank park under the terms and conditions of the attached agreement will serve an important county purpose by ensuring that the park will remain open and available to all county residents.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The King County executive is hereby authorized to enter into an interlocal agreement, substantially in the form of the attached agreement, with the city of Mercer Island relating to the transfer of Luther Burbank park.
