STATEMENT OF FACTS
1. The Alderwood water and wastewater district ("the district") and King County entered into a long-term agreement for sewage disposal dated December 1, 1966, as amended and previously extended through 2036.
2. The King County council approved Ordinance 15666 in 2006, which authorizes the executive to extend and amend the long-term sewage disposal agreements with specified cities and special purpose districts, including the Aldewood water and wastewater district.
3. The 2012 Budget Ordinance, Ordinance 17232, Section 116, Expenditure Restriction ER5, states, "[i]f the executive does not transmit by October 1, 2012 a proposed new or extended contract between King County and AWWD [the district] for services through at least 2050 that has been agreed to by AWWD [the district] the unexpended funds and the remainder of the 2012 appropriation shall be expended to complete the final design of the North Creek interceptor with the least costly project design that is sufficient to meet contractual obligations between King County and AWWD [the district] through 2036."
4. King County has proposed certain changes to, and a second extension of, the term of the long-term sewage agreement through 2056 between the county and the district consistent with Ordinance 15666.
5. The district has agreed in principle to the county's proposed extension and amendments subject to agreement between the county and the district on the boundaries of a flow swap. "Flow swap" in this context means that the wastewater flows from one area currently served by the county's facilities will be sent to a different facility for treatment while flows from approximately the same number of customer equivalents in another portion of the district's service area ...
