AN ORDINANCE relating to the annexation of approximately 95.67 acres of land into King County Water District No. 119, known as the Kelly Road Annexation, for the purpose of water service.

STATEMENT OF FACTS:
1. A notice of intention proposing the annexation of approximately 95.67 acres of land into King County Water District No. 119, known as the Kelly Road Annexation, for the purpose of providing water service was filed with King County on August 19, 2026.
2. King County Water District No. 119 adopted Resolution No. 551 on April 1, 2026, declaring its intent to annex the area, and Resolution No. 552 on May 6, 2026, approving the annexation subject to review and approval by the Boundary Review Board.
3. King County Water District No. 119 issued a determination of nonsignificance on the proposed annexation dated March 4, 2026.
4. The county approved the most recent water system plan for King County Water District No. 119 in 2016, as part of Ordinance 18260. The proposed annexation area is within the district's existing water service area.
5. The Boundary Review Board for King County received no request for a public hearing during the review period and deemed the proposed annexation approved by operation of law effective October 5, 2026.
6. The county council held the legally required public hearing and has considered the criteria in RCW 57.02.040.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The annexation of approximately 95.67 acres of land into King County Water District No. 119 for the purpose of providing water service described in Attachment A to this ordinance is approved. Approval of this annexation is consistent with RCW 57.02.040.
SECTION 2. King County Water District No. 119 is the appropriate entity to serve the area proposed to be annexed.
