Title
AN ORDINANCE authorizing the King County executive to execute a contract for phase II site facilities construction of the new Bow Lake recycling and transfer station.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. Ordinance 16247, approved October 3, 2008, directed the King County executive, through the solid waste division of the department of natural resources and parks (“the division”) to procure a contractor for construction of site facilities for the new Bow Lake recycling and transfer station using the competitive negotiation process in RCW 36.58.090.
B. Ordinance 16247 included draft evaluation criteria for the review of competitive proposals in accordance with RCW 36.58.090 and established a procedure to develop and use final evaluation criteria. Proposed final criteria were transmitted to the King County council for review and comment on December 16, 2009. No objections to the proposed final criteria were received and the criteria took effect twenty-one days after transmittal.
C. A request for proposals was issued on January 22, 2010, to the three highest-ranked applicants selected through evaluation of statements of qualification previously submitted. All three submitted technical proposals on April 23, 2010, and sealed price proposals on April 30, 2010. The evaluation criteria were used to evaluate the technical proposals and Lydig Construction, Inc., received the highest score and has been initially determined to be the best qualified.
D. Funding for the project has previously been appropriated.
E. Documents, including the request for proposals, provided by the division to contractors, anticipated an October 2010 start date, and contractors based key personnel availability, small contractor participation, and project costs on being able to begin construction in the fall of 2010.
