AN ORDINANCE authorizing the King County executive to enter into an interlocal agreement with the city of Sammamish for the provision of surface water services and transfer of drainage facilities and property interests.

STATEMENT OF FACTS:
1. The city of Sammamish (Sammamish) recognizes the need for comprehensive surface water management (SWM) and drainage services to preserve and protect the environment, public and private property, and the health and welfare of its citizens.
2. Since its incorporation in 1998, Sammamish has the legal authority for a surface water management and drainage services program financed by a service charge on developed properties.
3. King County has an established program of services to address the management of storm and surface water runoff and other water resource related functions.
4. Through an interlocal agreement, King County is able to provide surface water management and drainage services to Sammamish's residents and property owners, and Sammamish wishes King County to provide these services.
5. King County has provided drainage-related services to Sammamish residents under agreement since 1998 and welcomes the opportunity, under a new interlocal agreement, to continue a fruitful service provider relationship with the city and its residents.
6. King County and Sammamish wish to provide, under interlocal agreement, a mechanism through which King County may transfer to Sammamish ownership of, and responsibility for, drainage facilities and properties processed under King County development regulations but now falling within city limits and serving city residents.
7. Pursuant to chapter 39.34 RCW, the Interlocal Cooperation Act, the parties are each authorized to enter into an agreement for cooperative action.
