AN ORDINANCE revising the corporate boundary of the city of Kirkland to include the remaining portion of parcels of land located partially without the city boundaries and within unincorporated King County, as provided for in RCW 35.13.340 and to clarify the city boundary.

STATEMENT OF FACTS:
1. The city of Kirkland resolution number R-4538 was received by King County on December 21, 2005.
2. On November 23, 1987, the city of Kirkland passed Ordinance 3063, enacting its Lower Juanita Annexation, which was located generally east of 92nd Avenue NE, and extending north of Lake Washington to NE 132nd Street.
3. The Lower Juanita Annexation was ambiguous such that the city of Kirkland identified the boundary as the eastern margin of the vacated 92nd Avenue NE right-of-way and King County identified the boundary as the north-south center of section line for Section 30, Township 26N, Range 5E.
4. The eastern portion of the 92nd Avenue NE right of way, south of NE 120th Street, was dedicated as part of the Water Front Addition to Kirkland on November 8, 1890, and has remained unopened since its dedication. As a matter of law, it was automatically vacated pursuant to the laws of 1889-90, Chapter 19, Section 32, page 603, amended in laws of 1909, chapter 90, section 1, page 189, now codified in RCW 36.87.090.
5. The city of Kirkland resolution number R-4538 approves modification of the city boundary line to include the vacated eastern portion of the unopened 92nd Avenue NE right-of-way within the boundaries of the city of Kirkland.
6. RCW 35.13.340 authorizes a boundary adjustment by a city to include the remaining portion of a parcel of land located in the unincorporated area of a county to the city.
7. Revision of the corporate boundary of a city is effective upon approval by the city council and the county legislative authority as provided for in RCW 35.13.340.
