STATEMENT OF FACTS:
1. RCW 26.50.060(1)(g) authorizes the superior court and the district court to order the respondent in a domestic violence prevention proceeding under chapter 26.50 RCW to pay administrative court costs and service fees, as established by the county incurring the expense.
2. It is in the public interest to prevent domestic violence and to allow petitioners access to the courts. In order to support this public policy and ensure that district court services are available, establishing a fee to cover administrative court costs incurred by the district court is necessary.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. A. Section 2 of this ordinance adopts fees to cover administrative court costs and service fees in certain domestic violence cases that may be imposed against the respondent by the district court under chapter 26.50 RCW.
B. These fees are assessed under RCW 26.50.060(1)(g).
C. County legislative authorities may adjust the fees to cover the costs of administration and operation under RCW 26.50.060(1)(g).
NEW SECTION. SECTION 2. There is hereby added to K.C.C. chapter 4.79 a new section to read as follows:
A. The following district court administrative fee for district court costs is established to cover administrative district court costs in domestic violence cases:
District court administrative court cost fee $63.00
B. This fee may be imposed by the district court against the respondent in
domestic violence cases as authorized by state law.
SECTION 3. This ordinance takes effect January 1, 2009.
