AN ORDINANCE relating to an interlocal agreement between King County and the Central Puget Sound Regional Transit Authority for full-time transit police services; authorizing the executive to execute an amendment extending the term of the agreement authorized by Ordinance 17715; and amending its Exhibit B; and declaring an emergency.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  Findings:

                     A.  In December 2013, the county council adopted Ordinance 17715, which authorized the county executive to execute an interlocal agreement between King County and the Central Puget Sound Regional Transit Authority for full-time police services between January 1, 2014, and December 31, 2018.  Any amendment to that agreement required council authorization by ordinance.

                     B.  During 2013, the board of directors of Sound Transit, which is formally known as the Central Puget Sound Regional Transit Authority, approved motion 2013-60, which authorized the Sound Transit chief executive officer to execute an agreement with King County for full-time police services between January 1, 2014, and December 31, 2018.

                     C.  In October 2018, the board of directors of Sound Transit approved motion 2018-117, which authorized the Sound Transit chief executive officer to execute an agreement with the King County Sheriff's Office for seven years with two seven-year options for extensions, which would provide sworn law enforcement services between January 1, 2019, and December 31, 2040.

                     D.  The King County council will not have had the opportunity to review and take action on the new agreement prior to the expiration of the existing agreement, which shall occur on December 31, 2018.  As a result, it is essential that the existing agreement be extended for short time, with a revised Exhibit B, an annual costs of services for 2019, which is Attachment A to this ordinance, so that the provision of police services to Sound Transit is not interrupted.

                     SECTION 2.  The county executive is hereby authorized to execute an amendment to the agreement authorized by Ordinance 17715, extending the term of the agreement for no longer than February 28, 2019.  The agreement shall be also be amended to include an updated Exhibit B, cost of services list, for 2019.

                     SECTION 3.  The county council finds as a fact and declares that an emergency

exists and that this ordinance is necessary for the immediate preservation of public peace, health or safety or for the support of county government and its existing public institutions.
