Title

AN ORDINANCE relating to the removal of approximately 80 acres of land from the Ames Lake water association and annexation into the Sammamish Plateau water and sewer district, known as the M-Brooke Farm Water Annexation, for the purpose of water service.

Body

STATEMENT OF FACTS:

1.  A notice of intention proposing the removal of two parcels of approximately 80 acres of land, from the Ames Lake water association and annexation into the Sammamish Plateau water and sewer district, known as M-Brooke Farm Water Annexation, for the purpose of providing water service was filed with the county council on August 21, 2022.

2.  The M-Brooke Farm Water Annexation parcels receive water service from the Sammamish Plateau water and sewer district.

3.  The M-Brooke Farm Water Annexation area is on the boundary of the two districts’ water service boundaries.

4.  The Sammamish Plateau water and sewer district 2018 water comprehensive plan revised October 2019 reflects the annexation in the district's future water service area.

5.  Ames Lake water association board of directors approved the M-Brooke Farm Water Annexation on December 10, 2019.

6.  The Sammamish Plateau water and sewer district has approved the proposed transfer in Resolution No. 5119, passed on July 25, 2022.

7.  The Sammamish Plateau water and sewer district filed a determination of nonsignificance on the proposed transfer dated March 9, 2022.

8.  The utilities technical review committee reviewed the Sammamish Plateau water and sewer district 2018 water comprehensive plan and found that plan met the criteria for approval.  The county approved the most recent plan for the Sammamish Plateau water and sewer district in 2020, as part of Ordinance 19069.

9.  The county council held the legally required public hearing and has considered the criteria in RCW 57.02.040.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The removal of approximately 80 acres of land from the Ames Lake water association and annexation into the Sammamish Plateau water and sewer district for the purpose of providing water service described in Attachment A to this ordinance is approved.  Approval of this proposed annexation is consistent with RCW 57.02.040.

                     SECTION 2.  The Sammamish Plateau water and sewer district is the appropriate entity to serve the area proposed to be annexed.

                     SECTION 3.  Completion of this annexation does not constitute county approval

or disapproval of any other permits, certifications or actions necessary to provide service to this annexation area.
