AN ORDINANCE authorizing the vacation of a portion of
236th Avenue Southeast (File V-2382).  Petitioner:  Polygon Northwest

STATEMENT OF FACTS
1.  A petition has been filed requesting vacation of that portion of 236th Avenue Southeast hereinafter described.
2.  The department of transportation solicited comments and recommendations regarding the proposed road vacation from various King County agencies.  The utility companies serving the area were also notified concerning the proposed vacation.  The department of transportation, road services division was advised that the Sammamish Plateau Water and Sewer District requires easements for water/sewer extensions.  The designs for the water and sewer extension are under review at the district for approval.  This road vacation is in conjunction with the proposed plat of Aspen Meadows.  All easement requirements will be addressed in the platting process.
3.  The department of development and environmental services, land use services division (LUSD) staff has studied the proposed road vacation.  LUSD reported that no hearing for the proposed plat of Aspen Meadows (L97P0041) has been scheduled at this time.  This road vacation involves not only the proposed plat, but also a commercial building permit (Mclean North, B98C0212).  LUSD reports that there are no conflicts with the road vacation and the proposed plat of Aspen Meadows.
4.  A review of the records indicates that no public funds have been expended for the acquisition, improvement, or maintenance of 236th Avenue Southeast.  Therefore, this portion of 236th Avenue Southeast is classified as a "C" Class road vacation area.
5.  The road services division considers the subject right-of-way unnecessary as part of the County road system.
6.  In accordance with K.C.C. chapter 14.40, the amount of compensation for the vacation area is $3,060.00, based on fifty percent of the assessed value of the petitioner's land as determined from the records of the department of assessments.  The value of the replacement right-of-way to be dedicated in the plat of Aspen Meadows is of greater value than the vacation compensation amount.
7.  The department of transportation, road services division considers the exchange of right-of-way necessary as part of the county road system, and believes the public will benefit from both the new realignment of right-of-ways, and the return of the unused portion of the old alignment of 236th Avenue Southeast to the public tax rolls.  
8.  The road services division recommends that the council accept the value of the dedication of right-of-ways in lieu of compensation for vacating a portion of 236th Avenue Southeast.
      Due notice was given in the manner provided by law and a hearing was held by the office of the hearing examiner on the 3rd day of February, 2000.
      In consideration of the benefits to be derived from the subject vacation, the council has determined that it is in the best interest of the citizens of King County to grant said petition.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The council, on the 28th day of February, 2000, hereby vacates and abandons that portion of 236th Avenue Southeast described as follows:
That portion of 236th Avenue Southeast as dedicated for public use over the westerly 30 feet of Lot 1, King County Short Plat Number 1080091, recorded under Recording Number 9203300594, records of King County, Washington.
Containing an area of 7,650 square feet more or less.
