AN ORDINANCE related to establishing a traffic infraction for parking violations and establishing a local monetary penalty for failure to respond to each notice of parking infraction established by King County ordinance; establishing an effective date; adding a new section to K.C.C. chapter 46.04; and prescribing penalties.

STATEMENT OF FACTS:
1. The King County council adopted Ordinance 5292, codified as K.C.C. chapter 46.04, which adopted and incorporated by reference as King County's traffic code, with certain exceptions, the Washington Model Traffic Ordinance, chapter 308-330 WAC, hereinafter referred to as the "MTO."
2. RCW 46.63.110(4) allows a local legislative body to set a monetary penalty, not to exceed twenty-five dollars, for failure to respond to a notice of traffic infraction relating to parking as defined by local law or ordinance.
3. Currently King County imposes no penalty for failure to respond to a notice of traffic infraction relating to parking as defined in the MTO and adopted in K.C.C. chapter 46.04.
4. It is in the public interest and necessary to the enforcement of traffic infractions relating to parking that a penalty for failure to respond to a notice of traffic infraction be imposed.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
NEW SECTION. SECTION 1. There is hereby added to K.C.C. chapter 46.04 a new section to read as follows:
A. It is a traffic violation, and therefore subject to disposition under applicable state law and court rule, to not comply with any parking restriction in:
1. The MTO, as adopted and incorporated by reference by this chapter;
2. K.C.C. 46.04.060; or
3. K.C.C. 7.12.250.
B. A monetary penalty of twenty-five dollars is established for failing to respond within the time prescribed by chapter 46.63 RCW to a notice relating to a traffic violation
relating to one or more parking violations set forth in KCC 46.04.010.
SECTION 2. This ordinance takes effect January 1, 2009.
